The #MAKEPROCUREMENTAWESOME PLATFORM is a set of web pages and functionalities provided by SAP Ariba that allows visitors to share their procurement experiences (the “Platform”). The SAP Terms of Use found here, in addition to the terms and conditions in this document, govern your use of the #MAKEPROCUREMENTAWESOME Platform (the combination of the SAP Terms of Use and the additional terms and conditions below are referred to as the "Platform Terms of Use"). Unless otherwise indicated, all capitalized words used below shall have the same meanings given to such words in the SAP Terms of Use.

By clicking "I Accept", "I Agree" (or clicking a similar expression of acceptance) or by attempting to access or use the #MAKEPROCUREMENTAWESOME Platform, including any SAP Materials or User Content made available through the Platform, You agree that the Platform Terms of Use form a legally binding agreement between You ("You" or "Your") and SAP SE, for and on behalf of itself and its subsidiaries and affiliates (as defined in Section 15 of the German Stock Corporation Act), and You agree to be bound by the Platform Terms of Use. If You are accessing the Platform on behalf of Your employer in your capacity as an employee, or as a consultant or agent of a third party (this third party being in any of these cases being referred to as "Your Company"), You represent and warrant that You have the authority to act on behalf of and bind Your Company to the Platform Terms of Use, and everywhere in this Agreement that refers to 'You' or 'Your' shall also include Your Company. If You do not agree to these terms, do not click "I Accept", and do not attempt to access or use the Platform, any SAP Materials, or the User Content.


The Platform enables You to post stories in a written or video form so that You can share how You #MakeProcurementAwesome are transforming the process of Procurement in your industry and/or your company. The stories that You submit are considered “User Content” under the SAP Terms of Use. You do not need to be an Ariba Network customer or user in order to use the Platform and share Your story on the #MakeProcurementAwesome Platform. If You are an Ariba Network customer, Your use (Your Company’s use) of the Ariba Network is separate and distinct from Your use (or Your Company’s use) of the #MakeProcurementAwesome Platform. The terms of Your customer agreement for the Ariba Network do not apply to Your use of this Platform, and the Platform Terms of Use do not apply to Your use of the Ariba Network, if any.


In order to access or use the Platform You are required to create an account and register. Section 8 of the SAP Terms of Use (Your Information, Privacy, and Data Protection) contains information about the creation and maintenance of Your account, and how Your Personal Data will be handled. Stories that You submit to be published on the Platform are considered User Content under the SAP Terms of Use, and all rights, restrictions, and obligations that apply to User Content in the SAP Terms of Use apply to stories that You submit. Below are some of the restrictions contained in the SAP Terms of Use that apply to Your stories and Your use of the Platform. This list is not intended to exclude or limit any other restrictions or obligations in the SAP Terms of Use. You may not:

  • publish, upload, post, email, transmit or otherwise make available any User Content that (a) You do not have the right to make available (b) is unlawful, harmful, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable; (c) infringes any Intellectual Property Rights of any party, (d) includes any unsolicited or unauthorized advertising, promotional materials, surveys, junk mail, spamming, chain letters, or any other form of solicitation, commercial or otherwise, or (e) contains a software virus, Trojan horse, worm, time bomb, cancelbot, corrupted file, or any other computer file or software designed to interrupt, destroy, damage or limit the functionality of any computer hardware, software or other property;
  • defame, harass, abuse, stalk, threaten or violate the legal rights of others such as rights of privacy and publicity or business integrity;
  • impersonate any person or entity, including, but not limited to, an SAP official, SAP employee, or any other third party, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
  • forge email headers or otherwise manipulate identifiers to disguise the origin of any User Content transmitted through the SAP Websites;
  • download any file or User Content posted by another user that You know, or reasonably should know, should not be legally reproduced, displayed, performed and/or distributed in such manner;
  • interfere with or disrupt the servers, or networks which support the SAP Websites, or disobey any requirements, procedures, policies or regulations of networks connected to the SAP Websites;
  • violate any applicable local, state, national or international law and any regulations;
  • harvest, collect, or store personal information or data of other users.

You are solely responsible for Your stories and all User Content You submit. You represent and warrant that: (i) You either are the sole and exclusive owner of all User Content that You submit, or you have all rights, licenses, permissions, consents and releases that are necessary to grant to SAP the rights to that User Content outlined in the Platform Terms of Use; and (ii) neither the User Content nor Your use of the User Content, nor SAP’s exercise of any of the rights granted to it to use the User Content will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

Other than content authored by SAP, all views expressed on the Platform are those of the third parties submitting the stories and are not endorsed by SAP.


SAP does not claim any ownership of your stories, and as a result, there is no restriction on Your rights to use Your User Content outside of the Platform. The SAP Terms of Use, however, do grant SAP broad, perpetual, and irrevocable rights to use and publish the stories You submit. The rights that You grant SAP include, but are not limited to rights to use, copy, adapt, modify, distribute, reference, store, cache, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast and otherwise exploit User Content on the Platform and on and through third-party distribution channels selected by, but not affiliated with, SAP, in any form, medium or technology now known or later developed, in whole or in part, for any purposes, including for both commercial and non-commercial purposes. SAP may also grant third parties the right to use Your User Content as described above. You also grant each user of the Platform a non-exclusive license to access Your User Content through the Platform, and to use, reproduce, distribute, display and perform such User Content as permitted by SAP and the functionality of the Platform. If you do not want to grant SAP these rights to use the stories You submit, or You do not have the authority to grant these rights with respect to Your stories or any of the content in Your stories (e.g., text, music, images, video, etc.), You should not submit Your story to be published on the #MakeProcurementAwesome Platform.


SAP may elect not to post or publish stories (i.e., User Content) that You submit. If SAP elects to post or publish Your User Content, SAP may in its sole discretion withdraw the posted or published User Content for any reason and without notice even if SAP has previously indicated to You that SAP might or will post the User Content You have submitted.


The #MakeProcurementAwesome Platform is a public forum, and You agree not to provide SAP or other Users with any confidential or proprietary information that You or the owner of the information do not intend to become public. Any User Content that You upload to the Platform will NOT be deemed to be or treated as confidential or proprietary, and You expressly agree that You waive any trade secret or other confidentiality rights with respect to User Content published on the Platform.
